Can the Government Mandate Vaccinations?
Now that the Covid-19 vaccine is finally here, everyone wants to know if the government can force you to get a vaccine. Those who know about Jacobson v. Massachussetts in 1905 say the answer is obvious. This was during an outbreak of smallpox in New England where Massachussetts imposed a mandatory vaccine law. Rev. Henning Jacobson went to court arguing that that violated his constitutional rights. Justice John Harlan emphasized the importance of liberty, but liberty allows you to live your life as long as you're not harming other people. The government can restrict liberty when necessary to protect the public.

How a Case Gets to the Supreme Court
Despite what you hear on TV or in the movies, you can't just take a case to the Supreme Court. The Supreme Court will only hear a very small fraction of cases involving a very small fraction of disputes. The Supreme Court only hears three types of suits: appeals from state courts, appeals from federal courts, or cases where the supreme court has original jurisdiction. The entire process of how a Supreme Court case gets filed is explained by Anastasia.

Are Race and Gender Quotas Constitutional?
"The truth about quotas is that they treat people as interchangeable members of a group rather than individuals. Quotas require the very thing they are reportedly getting rid of, which is discrimination on the basis of race or sex. Quotas denigrate people's accomplishments. If a person gets hired, people will assume it was because of the quota, not one's educational background or great interview.

Certificate of Need Laws
A certificate of need is not like your ordinary license. When getting a traditional license, a person will have to go through certain training, accreditation, schooling, and apprenticeship. A certificate of need has nothing to do whether you're qualified. The only thing a certificate of need program purports to do is to decide whether a new business is needed and it is the established competitors who gets to weigh in on that. Existing competitors who hold a certificate are invited to testify about whether they think the new competition is really needed. Most of the time, a new application is protested and then denied.
